Article 549 of Commercial Code

1 - If an insurmountable event of force majeure prevents presentation of the cheque or the drawing up of a protest or its equivalent within the prescribed time limits, those time limits shall be extended. 2 - The holder must notify the person who endorsed the cheque to him of the event of force majeure without delay and Law Index 1337 Home Page Commercial Code Decree-Law No. 68 of 1980 Promulgating the Commercial Code record this notification, dated and signed, on the cheque or on the sheet attached thereto, and the notifications shall proceed in succession until they reach the drawer. - After the event of force majeure has ceased, the holder must present the cheque for payment without delay and then draw up the protest or its equivalent where necessary. - If the event continues for more than fifteen days calculated from the date of the day on which the holder notified his endorser of the occurrence of the event of force majeure, even if that date falls before the expiry of the time limit for presenting the cheque, recourse may be had against the persons liable without the need to present the cheque or draw up a protest or its equivalent. h - Matters relating personally to the holder of the cheque or to the person whom he has entrusted with presenting it or drawing up the protest or its equivalent shall not be considered events of force majeure.
