Article 546 of Commercial Code

English translation

1 - The holder of a cheque may have recourse against the drawer or endorsers and other persons liable thereunder if he presents it within the statutory period, its amount is not paid, and he establishes the refusal of payment by protest. In lieu of protest, refusal of payment may be established: a - By a statement issued by the drawee mentioning the day on which the cheque was presented. b - By a statement issued by a clearing house stating that the cheque was presented within the statutory period and its amount was not paid. The statement must be dated, written on the cheque itself, and signed by its issuer. 2 - It is not permissible to refuse to place the statement mentioned in the preceding paragraph on the cheque if the holder requests it, even if the cheque contains a stipulation for recourse without expenses. However, the drawee may request a period not exceeding the business day following presentment of the cheque, even if it was presented on the last day of the presentment period.
