English translation
The holder shall retain his right of recourse against the drawer even if the holder did not present the cheque to the drawee or did not draw up the protest or its equivalent within the statutory time limit, unless the drawer had provided funds for payment and those funds remained with the drawee until expiry of the cheque's time limit, and the funds then ceased to exist through an act not attributable to the drawer.

يحتفظ الحامل بحقه في الرجوع على الساحب ولو لم يقدم الحامل الشيك إلى المسحوب
عليه أو لم يقم بعمل البروتستو أو ما يقوم مقامه في الميعاد القانوني إلا إذا كان الساحب
قد قدم مقابل الوفاء وظل هذا المقابل موجودا عند المسحوب عليه حتى انقضاء
