Article 168 of Kuwaiti Penal Code

Any person who undertakes, other than in emergencies, to perform a surgical operation on another person, to treat that person, or to carry out a lawful act involving a danger threatening life or health, and who does not possess the requisite degree of technical expertise, or does not exercise due care in carrying out his work, thereby causing the death of the victim or injury to him, shall be punished in accordance with the provisions set out in Articles 154 and 164.
