Article 55 of Private Sector Labour Law

Wage means the basic wage that the worker receives or ought to receive in return for and by reason of his work, together with all elements stipulated in the contract or the employer's regulations. Without prejudice to the social allowance and children's allowance prescribed pursuant to the aforementioned Law No. 19 of 2000, calculation of the wage shall include the allowances, bonuses, supplements, grants, gifts or monetary benefits received by the worker periodically. If the worker's wage is fixed as a share of net profits and the establishment makes no profit or makes a very small profit such that the worker's share is not commensurate with the work he has performed, his wage must be assessed on the basis of the wage for comparable work, professional custom or the requirements of justice.
