Article 10 of Code of Civil Procedure

Except as provided in special laws, the notice shall be sent in the following manner, otherwise service shall be void: a- In matters relating to the State, the notice shall be sent to the ministers, directors of the competent departments and governors, or their substitutes, except for statements of claim, petitions of appeal, all litigation papers in the action or appeal, and judgments, for which the notice shall be sent to the Department of Legal Opinions and Legislation. b - In matters relating to public legal persons, the notice shall be sent to their legal representative or his substitute. As for statements of claim, petitions of appeal, all litigation papers in the action or appeal, and judgments, the notice shall be sent to the Department of Legal Opinions and Legislation, except those relating to the Municipality, for which the notice shall be sent to its Legal Department, unless the law specific to any of those persons provides otherwise. Where the notice under paragraphs a and b is sent to the Department of Legal Opinions and Legislation, it may be delivered to the person delegated by the Head of the Department of Legal Opinions and Legislation at the courts for this purpose. c- In matters relating to prisoners, the notice shall be sent to the prison director or his substitute. d - In matters relating to seafarers on merchant ships, or those working on them, a copy of the notice shall be delivered—if the ship is anchored in a Kuwaiti port—to the master or the ship's agent. e - In matters relating to companies, associations and all other private legal persons, if service by email or any modern electronic means of communication is impossible, a copy of the notice may, with the court's permission, be delivered to their legal representative, one of those responsible for their management, one of the general partners, or the substitute of any of these. If the person to be served is not present, the copy shall be delivered to a person who states that he is an employee at the management headquarters. If they have no management headquarters, the copy shall be delivered to one of the aforementioned persons personally or at his workplace or original or elected domicile. The provision of Article )9( of this Law shall apply to service in this case. f- In matters relating to army, police or National Guard personnel, including officers, non-commissioned officers and other ranks, the notice shall be sent to the Ministry of Defence, the Ministry of Interior or the National Guard, as the case may be, whenever service is requested at their workplace. )2(
