English translation
If the sole purpose of an action or a defence therein is vexation, compensation may be awarded against the person who intended that purpose. The court that heard the vexatious action or defence shall have jurisdiction to hear this claim, which shall be brought before it by an incidental application or an independent action, unless the claim, by reason of its value or nature, does not fall within its jurisdiction.

إذا قصد من الدعوى أو الدفاع فيها مجرد الكيد، جاز الحكم بالتعويض على من
قصد ذلك، وتختص بنظر هذا الطلب المحكمة التي نظرت الدعوى أو الدفاع
الكيدي، ويرفع إليها بطلب عارض أو بدعوى أصلية، وذلك ما لم يكن الطلب
