Article 140 of Code of Civil Procedure

The value of the action for purposes of the appeal threshold shall be assessed in accordance with the provisions of Articles (from 37 to 44). Undisputed claims and amounts formally tendered shall not be included in this assessment. Where an incidental claim is submitted by the defendant, the assessment shall be based on whichever of the two claims, original or incidental, is greater in value, unless the incidental claim seeks compensation for bringing the original action or for the manner of conduct therein, in which case only the original claim shall be taken into account. In assessing the appeal threshold for judgments issued before determination of the merits, the value of the action shall be taken into account.
