Article 238 of Code of Civil Procedure

Ten days after the date of his declaration of indebtedness, the garnishee shall pay the attaching creditor the amount he acknowledged or so much thereof as satisfies the attaching creditor's right, provided that, at the time of payment, that right is established by an enforceable instrument and the procedures provided for in Article 209 have (1) Amended pursuant to Decree-Law 59 of 2025 Law Index 656 Home Page Code of Procedure Decree-Law No. 38 of 1980 Promulgating the Code of Civil and Commercial Procedure been observed.
