Article 259 of Code of Civil Procedure

The attaching creditor shall be entitled to proceed with enforcement if the court orders the action struck out or stayed pursuant to Article 70, or if it is deemed never to have been brought or a judgment is rendered deeming it so. The attaching creditor shall also be entitled to proceed with enforcement if a judgment is rendered in the action dismissing it, declaring lack of jurisdiction, declaring it inadmissible, declaring its statement of claim void, declaring the proceedings lapsed, or accepting its abandonment. The attaching creditor shall proceed with enforcement even if the judgments referred to in the preceding paragraph are subject to appeal.
