Article 35 of Copyright and Related Rights Law

The court of urgent matters shall have jurisdiction, upon the application of interested parties, to take the following measures or other appropriate precautionary measures, upon infringement of any of Law Index 545 Home Page Copyright and Related Rights Law Law No. 75 of 2019 Promulgating the Copyright and Related Rights Law the rights provided for in this Law: 1 - Recording a detailed description of the work, performance, sound recording or broadcast programme. 2 - Temporarily suspending the publication, display, copying or manufacture of the work, performance, sound recording or broadcast programme for a specified period, which may be extended until the substantive dispute is determined. - Placing under protective custody the original work, sound recording or broadcast programme and its copies, as well as the materials, equipment and tools used to republish that work, performance, sound recording or broadcast programme, or to make copies thereof, provided that those materials are suitable only for republishing the work, performance, sound recording or broadcast programme. - Establishing the occurrence of infringement of the protected right. h - Ascertaining the revenue resulting from exploitation of the work, sound recording or broadcast programme and placing it under protective custody in all cases. The president of the court may order the appointment of one or more experts to assist the person entrusted with enforcement. The court may oblige the infringer of the right to pay fair and appropriate compensation for the damage sustained by the right holder as a result of that infringement.
