Article 153 of Environmental Protection Law

The penalties stipulated in this Law shall not apply to pollution cases resulting from: a - Ensuring the safety of lives, means of transport or cargo. b - Discharge resulting from damage sustained by the ship, aircraft or the equipment of either, provided that it was not carried out with the knowledge of the person responsible for either of them had taken, before and after the damage occurred, all adequate precautions to prevent or reduce the effects of pollution and immediately notifies the competent department. Home Page Law Index 310 Environmental Protection Law Law No. 42 of 2014 Concerning Environmental Protection c - A sudden rupture in a pipeline carrying oil or an oily mixture during operations or during drilling, exploration or selection of wells, without negligence in monitoring the operation of the pipelines and controlling the pollution and its source immediately upon its occurrence. All of this is without prejudice to the injured party's right of recourse against the person responsible for the costs of removing the effects arising from pollution and compensation for the losses and damage resulting from it.
