English translation
The person responsible for pollution shall be exempted from liability if he proves the damage was due to: a - Force majeure. b - If it occurred entirely because of an intentional act by a person having no contractual or subordinate relationship with the owner or operator. c - It occurred entirely because of negligence or fault caused by the competent administrative authority. Application of the preceding paragraph is conditional upon the person responsible for pollution having notified the competent department of the incident or its causes if he knew or ought to have known of it, and having taken all necessary precautions to prevent the incident or reduce the effects of pollution. يعفى المسئول عن التلوث من المسئوليه إذا أثبت الضرر كان بسبب :
أ - القوة القاهرة .
ب - إذا وقع كلياً بسبب تصرف عمدى من أحد الأشخاص اللذين لا تربطهم
بالمالك أو المشغل رابطة عقدية أو تبعية .
ج - وقع كلياً بسبب الإهمال أو الخطأ سببته السلطة الإدارية المختصة .
يشترط لتطبيق الفقرة السابقة أن يكون المسئول عن التلوث قد ابلغ الإدارة
المختصة بالحادث أو اسبابه إذا علم أو كان عليه أن يعلم به وأن يكون قد اتخذ
كافة الاحتياطات اللازمة لمنع الحادث أو التقليل من اثار التلوث .Ask about this article
