Article 43 of Law on the Practice of Medicine and Allied Health Professions

The head of the Agency or his deputy shall verify that there is no conflict of interests between candidates for membership of the committee and the matter submitted to it and its parties. They may communicate with the competent authorities to provide them with the data and information necessary to verify those conditions or circumstances before constituting the committee whenever possible, and then decide on the appointment of committee members or upon their replacement. Where a conflict of interests is established between a committee member and a party or the matter under examination and consideration, he must immediately recuse himself, whether on his own initiative or pursuant to a request submitted by the persons concerned to the head of the Agency explaining the nature of the conflict arising from an interest or connection and enclosing evidence thereof. The head of the Agency or his representative must then appoint a substitute member after verifying the absence of any connection or interest in the substitute member as previously described.
