Article 44 of Law on the Practice of Medicine and Allied Health Professions

The meetings of the committee formed by the Agency shall be recorded in special printed minutes prepared for that purpose, which shall be signed after each session by all committee members present. The committee’s meetings, minutes, decision and reports shall be confidential, and the information contained therein may not be disclosed, used or published except in accordance with what is prescribed in this Law. The committee must summon and hear the statements of the patient, his family or his legal representative, as well as the practitioners complained against and all members of the medical staff concerned and witnesses whose statements need to be heard. The committee shall have the right to conduct examination and medical examination procedures or entrust any competent entity with doing so. The committee may invite persons whose assistance it considers necessary to attend its meetings without having the right to vote. Testimony may be given before the committee formed by the Agency after taking an oath. A representative of legally licensed medical professional associations may attend the committee’s meetings, and the representative shall have the right to submit Contents of the Law 768 Home Page Practice of Medicine and Auxiliary Professions Law Law No. 70 of 2020 concerning the Practice of Medicine and Its Auxiliary Professions, Patients’ Rights and Health Facilities any written observations or information to the committee. If the violator does not appear before the committee despite having been notified, the report may be issued in his absence even if it includes the imposition of a disciplinary penalty upon him. The committee’s decisions and report shall be issued after the approval and signature of a majority of its members.
