State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The legislature prescribed the grant of a pension at 100% of the maximum salary fixed for the higher rank immediately following the beneficiary's rank in cases of termination of service for reasons including injury in the circumstances provided for in Article 10 of Law 69 of 1980 promulgating the Military Personnel Pensions and Gratuities Law, as amended, whatever the beneficiary's length of service(*). This law recognizes no compensation—other than the foregoing—for injury occurring during or because of the performance of work, or in military operations and battlefields in defence of the country's security. The judgment's adherence to this and its dismissal of the appellant's request for compensation for the injury by virtue of which he obtained an exceptional pension under the aforementioned Article 10. The challenge thereto. Unfounded. Likewise, the challenge to the judgment for not referring the case back to forensic medicine to determine the appellant's injury according to the diyah schedule. Unavailing.
