State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A stipulation in a fixed-term lease that it shall not terminate unless notice is given within a specified time. Failure to give that notification within the time. Its effect. Extension of the lease. - Notice to vacate by which the lease terminates. Its nature. How it is effected: by service through a bailiff, by registered letter, by ordinary letter, or by any official document clearly showing the lessor's wish to terminate the contract. - The respondent's notification to the appellant, by formal notice served through a process server, of her unwillingness to renew the lease and her notice to him to vacate. A valid procedure. This is not affected by the agreement that notice be by registered letter. The reason for this. Notice by formal warning through a process server is stronger in effect than other means. - 640 - Lease
