Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2395

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Specifying the condition concerning speed, driving against the direction of traffic, and passing a traffic light, so as to authorize the insurer to have recourse against the insured. Their being regarded as reasonable conditions that do not conflict with the insurance contract or public policy and pursue the legitimate desire to delimit the scope of liability by excluding certain situations to make the risk more probable. The necessary consequence of these conditions being in the policy is that the insurer has a direct action independent of the action for subrogation to the injured party’s rights.
