State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The Brussels Convention. Its application as part of the State's legislation. Its effect. Failure to give notice of loss or damage. Does not result in the extinction or inadmissibility of the liability action provided for in Article 453 of the Commercial Law, but rather in a legal presumption that the carrier delivered the goods in the manner described in the bill of lading. This presumption is rebuttable.
