State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The worker and the employer may prove the employment relationship by all means of proof so long as no written instrument exists to establish it. - 790 - Labour An oral contract is equivalent to a written contract. It may be proved whether for a fixed or indefinite term. Example. - The challenged judgment rejecting the appellant's claim for pay in lieu of notice on the basis that the papers did not disclose whether the employment contract was for a fixed or indefinite term, despite the respondent's not disputing that the appellant worked for it until it prevented her from working at the company. Deficiency requiring its quashing.
