State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The rights established by the provisions of the Labour Law are matters of public policy. It is impermissible for the worker to contravene them unless this results in a greater benefit to the worker. - A condition contrary to public policy. Void. Ratification does not cure it. - Inclusion in the employment contract of an arbitration clause concerning the worker’s rights prescribed by law. Invalidity of this clause because it concerns rights pertaining to public policy. Subsequent ratification does not cure this invalidity. Permissibility of concluding an arbitration agreement anew after eliminating the cause of invalidity and the establishment of the worker’s rights, by two concordant expressions of intent. - 867 - Labour
