State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The worker’s discharge of all his entitlements owed by the employer. A bar to his recourse against him for any such entitlement. This evidentiary force may not be repudiated or evaded. The condition thereof. That his will is not tainted by a defect of consent. - The challenged judgment’s conclusion that the discharge attributed to the appellant is binding evidence against him because it is valid, on the basis that the threat to cancel his residency and deport him from the country does not constitute moral duress invalidating consent, since these are rights conferred on the employer, and that the fear generated in the appellant arose from his own circumstances without intervention. Its subsequent disregard of the request to refer the action for evidentiary investigation. Does not render it defective. The reason therefor.
