Article 882 of Civil Code

English translation

If a person erects a building, plants or other installations, using his own materials, on land which he knows belongs to another and on which he has no right to erect them, or if his ignorance thereof arises from gross fault, the owner of the land may demand removal of the additions at the expense of the person who made them, together with compensation where warranted, within one year from the time he learned of their creation. If he does not demand removal, or requests retention of the additions, he shall be obliged to pay their value as liable to removal or pay the increase in the value of the land attributable to them.
