English translation
A mortgage shall not be forfeited to the mortgagee. Accordingly, any agreement granting the mortgagee the right, upon non-payment of the debt at maturity, to acquire ownership of the mortgaged immovable in exchange for the debt or at any price whatsoever, or to sell it without observing the procedures imposed by law, shall be void, even if such agreement was concluded after the mortgage. لا يغلق الرهن، فيقع باطلا كل اتفاق يجعل للدائن المرتهن الحق عند عدم استيفاء
