English translation
The accused shall be considered a fugitive in the following cases: First - If he has been arrested or detained and then escaped from arrest or detention. Second: If a valid lawful order for his arrest has been issued but could not be executed, and the person issuing the order has strong indications that the person sought for arrest has concealed himself. Third: If a valid lawful order for his arrest has been issued but could not be executed, and its subsequent execution is unlikely to be possible because the accused has no known place of residence in Kuwait.

يعتبر المتهم هاربا في الاحوال الآتية :
اولا - إذا كان قد قبض عليه او حبس، ثم فر من القبض او الحبس.
ثانيا : إذا كان قد صدر امر قانوني صحيح بالقبض عليه، ولكن لم يمكن تنفيذه،
وتوافرت لدى الأمر قرائن قوية على ان المطلوب القبض عليه قد اخفى نفسه.
ثالثا : إذا كان قد صدر امر قانوني صحيح بالقبض عليه ، ولكن لم يمكن تنفيذه،
ولم يكن من المحتمل امكان ذلك فيما بعد، لان المتهم ليس لـه محل اقامة معروف
