Article 166 of Code of Criminal Procedure and Trials

English translation

A witness is required to take the oath if he is of sound mind and has attained fourteen full years of age. If, however, the witness is young, or suffers from an illness or a serious disability that makes communication with him impossible or uncertain in its results, he may not be administered the oath and his statements shall not be considered testimony. However, if the court considers that hearing them would be useful, it may hear them for guidance, and in this case it may use movements or signs by which communication with such persons is possible, and seek the assistance of persons who can communicate with them.
