Article 95 of Code of Criminal Procedure and Trials

If the investigator finds that the seized items are not necessary for the investigation or for adjudicating the case, he may order their immediate delivery to the person from whose possession they were seized or to whomever he considers entitled to possess them. If doubt arises as to who has the right to possession, the investigator shall refer the matter to the president of the Court of First Instance, or the person acting in his stead, for determination. When the matter is referred to him, upon the investigator's request or upon a grievance submitted by an individual, the president of the court may, after hearing the statements of the persons concerned, order the return of the item to the person entitled to possess it, unless this prejudices the underlying ownership or the case under investigation. If, however, he finds that determining this matter requires addressing ownership or the subject matter of the case under investigation, he shall order that the matter be referred to the competent civil court or to the court hearing the merits, as the case may be.
