Article 287 مكرر of Jaafari Personal Status Law

If the deceased did not bequeath to the descendant of his child who died during his lifetime or died with him—even by legal presumption—an amount equal to his share of what his ascendant would have inherited from his estate had he been alive at his death, a bequest from the estate shall be obligatory for the descendant in the amount of that share, within the limit of one third, provided that he is not an heir and that the deceased has not given him, without consideration through another disposition, the amount due to him. If what he gave him was less than that, a bequest shall be obligatory for him in the amount of what he owns. This bequest shall be for those of the first degree of daughters’ children and for his sons’ children through the male line, however far down, provided that each ascendant excludes his own descendant but not the descendant of another, and that each ascendant’s share is divided among his descendants, however far down, according to the division of inheritance, as if his ascendant or ascendants through whom he is related to the deceased had died after him, and their deaths had occurred in the order of the degrees.
