English translation
The Bankruptcy Judge shall issue his decision declaring the application inadmissible if the documents and data provided for in Article 20 of this Law have not been submitted, or have been submitted incomplete without justification, unless he decides to accept the application on such conditions as he considers appropriate. He shall also issue his decision rejecting the application if its conditions are not met or if it becomes apparent to him that its sole purpose was to harm the debtor. In this case, the debtor and anyone harmed by the application may seek compensation for the harm suffered, and the liability action shall be brought before the Bankruptcy Court.

يصدر قاضي الإفلاس قراره بعدم قبول الطلب إذا لم يتم تقديم المستندات والبيانات
المنصوص عليها في المادة ۲۰ من هذا القانون، أو إذا قدمت ناقصة دون مسوغ،
وذلك ما لم يقرر قبول الطلب وفق الشروط التي يراها مناسبة.
كما يصدر قراره برفض الطلب إذا لم تتوافر شروطه أو تبين له أنه لم يقصد بـه سـوى
الإساءة للمدين، وفي هذه الحالة يجوز للمدين ولكل من لحقه ضرر من الطلب أن
يطلب تعويضاً عما أصابه من ضرر، وتقام دعوى المسئولية أمام محكمة الإفلاسAsk about this article
