A contract containing terms that place on the seller the risk of loss after shipment of the goods, make performance of the contract contingent upon the vessel's safe arrival, or give the buyer the option to accept the goods according to his wishes or according to the sample delivered to him, ceases to be a CIF sale or an FOB sale and shall be considered a sale subject to delivery at the place of arrival. العقد الذي يتضمن شروطا من شأنها تحميل البائع تبعة الهلاك بعد شحن البضاعة،
او تجعل امر تنفيذ العقد منوطا بوصول السفينة سالمة ، او تعطي المشتري الخيار في
قبول البضاعة حسب رغبته او حسب النموذج المسلم اليه، يخرج عن كونه بيع
