Article 214 of Commercial Code

1 - In the carriage of persons, the compensation awarded against the air carrier may not exceed six thousand dinars for each passenger unless the two expressly agree to exceed that amount. 2 - In the carriage of baggage or goods, compensation shall not exceed six dinars per kilogram. Nevertheless, if, when handing the baggage or goods to the carrier, the consignor makes a special declaration of the importance he attaches to their delivery at the destination and pays any additional charge the carrier may request in return, the carrier shall be bound to pay compensation in the amount of the value constructed in the declaration, unless the carrier proves that this value exceeds the actual importance the consignor attached to delivery. 3 - In the event of the disappearance, loss or damage of part of a package or some of its contents, the maximum compensation shall be calculated on the basis of the gross weight of the entire package, unless this affects the value of other packages included in the same consignment, in which case the weight of those packages shall also be taken into account. 4 - As regards small personal items remaining in the passenger's custody during travel, the compensation awarded to each passenger for those items may not exceed one hundred and twenty dinars.
