Article 38 of Commercial Code

1 - A seller bringing an action for rescission shall serve notice on creditors having registered entries against the business establishment at their elected domiciles indicated in their entries. 2 - If, at the time of sale, the seller stipulates that the sale shall be rescinded by operation of law if the price is not paid within the specified period, or if the seller and purchaser mutually agree to rescind the sale, the seller shall notify the registered creditors at their elected domiciles of the rescission or of the agreement thereon.
