Article 394 of Commercial Code

1 - If it is agreed to enter a debt secured by a contractual security in the current account, that security shall transfer to secure the account balance upon closure up to the amount of the debt, regardless of changes occurring in the account during its operation, unless otherwise agreed. 2 - If the law requires specified procedures for the creation of the security or for making it effective against third parties, its transfer to the balance shall not take place and it may not be invoked except from the date those procedures are completed.
