Article 103 of Code of Civil Procedure

A judge’s act or adjudication shall be void in the circumstances referred to in the preceding Article, even if carried out by agreement of the litigants. If such nullity occurs in a judgment issued by a chamber of the Court of Cassation, a litigant may request that chamber to set aside the judgment and rehear the appeal before a cassation chamber that does not include the counsellor who caused the nullity.
