Article 109 of Code of Civil Procedure

Submission of the first application for recusal shall entail a stay of the original action until the application is finally adjudicated. Nevertheless, the court considering the recusal application may, in urgent cases and at the request of a party, assign a judge in place of the person whose recusal is sought. Assignment may also be requested if the first-instance judgment rejects the recusal application and is appealed. Submission of an application to recuse the court considering the recusal application shall not entail a stay of its consideration. Nevertheless, where recusal of any of its members is sought, this court may, at the request of a party, order a stay of consideration of the recusal application. In this case, the provision of the first paragraph of this Article shall apply. )2(
