Article 110 of Code of Civil Procedure

If the recusal of all or some of the judges of the Court of First Instance is requested such that an insufficient number remains to adjudicate, the recusal application and the judges' responses thereto shall be referred to the High Court of Appeal. If it rules to allow it, it shall hear the action and render a final judgment on its merits. If the recusal of all or some of the councillors of the High Appeal Circuits is requested such that an insufficient number remains to adjudicate, the recusal application shall be referred to the Cassation Circuit. If it rules to allow it, it shall adjudicate the merits of the original action. If the recusal of one or more councillors of the Cassation Circuit is requested, a Cassation Circuit of which that councillor is not a member shall adjudicate the application. An application to recuse all or some of the councillors of the Cassation Circuits shall not be admissible where an insufficient number would remain to adjudicate the recusal application or the merits of the action if the recusal application is allowed.
