English translation
Judgments may not be compulsorily enforced as long as they remain open to appeal, unless expedited enforcement is provided for by law or ordered in the judgment. Nevertheless, precautionary measures may be taken pursuant to them. If the judgment creditor enforces a judgment subject to expedited enforcement, he shall be liable to compensate for the damage suffered by the person against whom enforcement is effected if the judgment is subsequently overturned, even if the applicant for enforcement acted in good faith. Article 193 (1) Expedited enforcement shall be mandatory by operation of law in the following cases: (a) Judgments rendered in urgent matters, regardless of the court that rendered them. (b) Judgments awarding maintenance, custody remuneration, breastfeeding remuneration, housing, delivery of a minor or visitation with a minor. (c) Orders issued on petitions and judgments rendered on grievances against them. (d) Judgments rendered in commercial matters. Expedited enforcement in the cases provided for in paragraphs (a), (b) and (c) shall be without security unless the judgment or order stipulates the provision of security. In the case provided for in paragraph (d), expedited enforcement shall be conditional upon the provision of security.
