Article 197 of Code of Civil Procedure

The person required to provide security shall give notice of his choice either through an enforcement officer in a separate document or within the notice of the enforcement instrument or the demand for payment. In all cases, the choice must include the designation of an elected domicile in Kuwait for the applicant for enforcement if he has no domicile or place of business there, so that documents relating to the dispute over the security may be served upon him there. Within three days of this notice, an interested party may bring an action before the Summary Court contesting the surety's financial capacity, the custodian's trustworthiness, or the sufficiency of the deposit. The judgment rendered therein shall be final. If the action is not brought within the prescribed time, or is brought and dismissed, the surety's undertaking to provide security, or the custodian's acceptance of custody, shall be taken at the Enforcement Department. The record containing the undertaking of the surety or custodian shall constitute an enforcement instrument against him in respect of the obligations arising from his undertaking.
