Article 12 of Law on the Practice of Medicine and Allied Health Professions

The physician must verify the patient's mental capacity before obtaining from the patient informed consent or advance directives concerning decisions relating to the patient's health in accordance with Article (30) of this Law, by ascertaining the following: Law Index 758 Home Page Law on the Practice of Medicine and Allied Professions Law No. 70 of 2020 concerning the Practice of Medicine and the Professions Allied Thereto, Patients' Rights and Health Facilities 1 - That the patient is conscious and aware of time, place, the patient's personal identity and the identity of those around the patient. 2 - That the patient is capable of understanding and comprehending the nature of the disease, the available treatment options, and the known and potential complications of each treatment option, in a manner commensurate with the patient's age, level of education and nature of work. If either of the above two conditions is absent, the patient shall not be considered to be in a state of health permitting the patient to give informed consent or express advance directives | In all cases, the physician shall carry out this assessment and procedure in the presence of two witnesses who are physicians or practitioners of professions allied to medicine, and shall record this in the patient's medical file The obligation not to disclose the patient's secrets
