Article 69 of Law on the Practice of Medicine and Allied Health Professions

Without prejudice to any more severe penalty prescribed by another law, anyone who commits any of the following acts shall be punished by imprisonment for a term not exceeding five years and a fine not exceeding ten thousand Kuwaiti dinars, or by either of these two penalties: 1 - Practises human medicine, dentistry or either one's auxiliary professions without obtaining a licence therefor, or under a licence that has been cancelled or withdrawn, whose renewal has been refused, or more than one hundred and twenty days have elapsed since its expiry, calculated from the day following the expiry date. 2 - Establishes, operates or manages a private health facility without obtaining a licence permitting this, or under a licence that has been cancelled or withdrawn. - Provides incorrect information or resorts to unlawful methods when applying for a licence or its renewal, resulting in his being granted a licence to practise human medicine, dentistry or either one's auxiliary professions. 4 - Uses publications, signs, boards or any other means of publication or advertising or any social media platform capable of misleading or inducing the public to believe that he is entitled to practise human medicine, dentistry or either one's auxiliary professions, contrary to the truth or to what is established in the licence granted to him. 5 - Assumes any capacity or title applied to practitioners of human medicine, dentistry or either one's auxiliary professions. 6 - Anyone who intentionally conceals or destroys the patient's medical file or any part of its contents.
