Article 35 of Decree-Law No. 15 of 1979 concerning the Civil Service

Employees in service at the time this Law enters into force who have reached the age prescribed for termination of service under its provisions shall have added to their actual service period counted for retirement purposes half the period remaining until they reach the age originally prescribed for termination of their service before it took effect. Anyone who has reached fifty-five years of age or older when this Law takes effect may request Law Index 818 Home Page Civil Service Decree Decree-Law No. 15 of 1979 concerning Civil Service within one year to be referred to retirement, provided that five years are added to his actual service. This period shall be added for anyone whose service terminates during the option period even if he has not submitted a request, except anyone whose service terminates by disciplinary dismissal pursuant to Article (28) or for one of the reasons stated in items (5, 6) of Article (32) of this Law. All of the foregoing shall be without prejudice to the maximum pension prescribed by law. Article 36 (1) The Civil Public Offices Law promulgated by Decree No. 7 of 1960 and Law No. 18 of 1960, as well as the aforementioned Law No. 14 of 1974, are repealed in respect of persons subject to the provisions of this Law. Every provision conflicting with its provisions is also repealed. All of the foregoing shall be without prejudice to the provisions contained in Chapter Four of the aforementioned Law No. (30) of 1964.
