Article 12 of Decree-Law No. 53 of 2026 Promulgating the Law Regulating Procedures for Parentage and Name Correction Actions

The name of an ascendant or the surname may not be corrected or changed, nor may a new surname be added or an existing surname deleted. Home Page Index of the Law 1247 Law of the Committee for Lineage Claims and Correction of Names Decree-Law No. 53 of 2026 Promulgating the Law Regulating Procedures for Lineage Claims and Correction of Names The following cases are excepted: 1- If the name or surname is established in official evidentiary documents or is absent from them. 2- Issuance of a final judgment establishing or denying lineage, or establishing the forgery of official documents recording the name or surname. - If the applicant shares a line of descent with a person who bears this name or surname in his official documents, or whose documents lack it, provided that it was not added to or deleted from the latter by a judgment or decision through a procedure other than that prescribed in this Law.
