State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The resignation of an employee referred for investigation, suspended from work, or subjected to any other disciplinary measures. Its acceptance is impermissible. If those measures conclude with a finding that he is not responsible or with his punishment by a penalty other than dismissal, it may be accepted. The employee must continue to perform his work until notified that his resignation has been accepted or until the expiry of the period specified for it to be deemed accepted, and he is entitled to his salary until the date of notification or the expiry of the aforementioned period. - The judgment's holding that the respondent ceased to have the status of a public employee from the date he submitted his resignation rather than from the date of the decision accepting it. An error in the application of the law requiring its cassation.
