English translation of the principle

Personal status actions that the legislature requires the Public Prosecution to institute or intervene in. It is considered a party to the action, possessing all the rights accorded to parties. - The Public Prosecution is indivisible. The consequence of this. The prosecution member who represented it by attending or expressing an opinion before the Court of Appeal may be the same person who represented it before the court of first instance. Its consequence. The rules disqualifying a judge from hearing an action because he previously expressed an opinion do not apply. The reason for this. The provision concerning the recusal of judges in Article 102 of the Civil Procedure Law is exhaustive and therefore may not be extended or applied by analogy to members of the Public Prosecution.
