The exercise of a right shall be unlawful if its holder diverts it from its purpose or its social function. In particular: (a) If the interest resulting from it is unlawful. (b) If its sole purpose is to harm another. (c) If the interest resulting from it is wholly disproportionate to the damage inflicted on another.
