Article 801 of Civil Code

1 - In insurance against damage, the insurer is subrogated by law, to the extent of the indemnity it has paid, to the actions available to the insured against the person legally liable for the insured damage, unless the person liable for the damage is a relative or relative by marriage of the insured living in the same household, or a person for whose acts the insured is responsible. 2 - The insurer shall be discharged towards the insured from all or part of the sum insured if its subrogation becomes impossible for a reason attributable to the insured.
